DMCA Policy
Severe Storms Detroit respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly provided to us.
This policy outlines the information required to submit a valid DMCA notice to Severe Storms Detroit and how we handle such notices, as well as the process for submitting a counter-notification if you believe your content was wrongly removed.
Filing a DMCA Infringement Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via Severe Storms Detroit's service, please send a written DMCA Notice to our designated Copyright Agent. For your notice to be valid under the DMCA, you must provide the following information:
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the infringing material: A description of the material that you claim is infringing and where it is located on our service (e.g., URL link). Sufficient information must be provided to allow us to locate the material.
- Your contact information: Your name, mailing address, telephone number, and email address.
- A statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement under penalty of perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Electronic or physical signature: An electronic or physical signature of the person authorized to act on behalf of the copyright owner.
Filing a DMCA Counter-Notification
If you believe that material you posted on Severe Storms Detroit was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. For your counter-notification to be valid under the DMCA, you must provide the following information:
- Identification of the removed material: Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL link) at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your contact information: Your name, address, telephone number, and email address.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Severe Storms Detroit may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Electronic or physical signature: Your physical or electronic signature.
